About Next Etch

These Terms & Conditions govern the purchase and use of Next Etch, available through nextetch.io. Next Etch is operated by José Antonio Tamudo Bértolo, NIF: 51231191W, Calle Río Guadarrama 45, Arroyomolinos, 28939, Madrid, Spain. By purchasing or using Next Etch, you agree to these Terms.

Next Etch is an independent product and is not affiliated with, endorsed by or operated by Etch. A separate valid copy of Etch is required to use Next Etch and must be purchased separately.

License and Permitted Use

Your purchase grants you a license to use Next Etch on an unlimited number of websites that you own, manage or build for clients. You may leave Next Etch installed on websites delivered to your clients. You may also deactivate Next Etch on one website and activate it on another.

Your customer account and license credentials are personal to you and may not be sold, rented, shared or transferred to third parties as a standalone product or service. You may not package or distribute Next Etch, its component library, documentation or other materials as your own product, or use them primarily to create and commercialize a competing component library or substantially similar product.

Certain portions of Next Etch may be subject to open-source licenses, including where required by licenses applicable to WordPress or other software. Any such open-source license governs the relevant code and nothing in these Terms restricts rights that must be granted under that license. All other rights, including rights relating to the Next Etch name, branding, website, documentation, customer accounts, license infrastructure, support and update services, are reserved.

Lifetime Deal

A Next Etch Lifetime Deal provides access to the product, updates and support for the commercial lifetime of Next Etch. "Lifetime" refers to the commercial lifetime of the product, not the lifetime of the purchaser or any particular website.

We intend to continue developing and maintaining Next Etch, but we do not guarantee that the product will operate indefinitely. We may eventually discontinue Next Etch or any associated service. A Lifetime Deal does not create an obligation to maintain the product permanently.

Payments and Pricing

Payments are processed through SureCart using supported payment providers such as Stripe and PayPal. Prices and any applicable taxes are displayed during checkout. We may change prices, promotions or purchase options at any time for future purchases, but such changes will not alter the price already paid for an existing Lifetime Deal.

If installment payment options are offered in the future, the total price and payment schedule will be shown before purchase. An installment plan is a method of paying for the Lifetime Deal and does not convert it into a recurring subscription. Failure to complete agreed payments may result in suspension of the license, updates and support until the outstanding amount is paid.

Refunds and Consumer Rights

We offer a voluntary 10-day refund guarantee from the original purchase date. You may request a refund within this period without providing a reason by contacting team@nextetch.io. Once a refund is issued, your license and access to downloads, updates and support will be revoked.

For refunds issued under this voluntary guarantee, transaction processing fees charged in connection with the original payment may be excluded from the refunded amount where permitted by applicable law. We reserve the right to refuse the voluntary refund guarantee in cases of clear abuse, including repeated purchasing and refunding for the purpose of continuing to use Next Etch without payment.

This voluntary refund policy does not limit any mandatory consumer rights that apply to you. Consumers may have additional statutory rights, including rights relating to withdrawal from distance contracts or non-conforming digital content. Where applicable law requires express consent and acknowledgement before a statutory withdrawal right can be lost following immediate delivery of digital content, those statutory requirements will apply regardless of these Terms.

Updates, Support and Compatibility

Lifetime Deal customers receive product updates and support for the commercial lifetime of Next Etch. Support is currently provided through team@nextetch.io and the official Next Etch Facebook community. We do not guarantee a specific response time.

Support does not include custom development, website configuration, general training in WordPress, Etch or GSAP, or troubleshooting issues caused exclusively by third-party plugins, themes, hosting environments or custom code.

Next Etch may evolve over time. We may add, modify, replace or remove components, features or integrations and may change technical requirements when reasonably necessary. We do not guarantee permanent compatibility with every version of WordPress, Etch, browser, hosting environment or third-party product.

Your Responsibilities

You are responsible for maintaining appropriate backups of your websites and for testing updates and significant changes before deploying them to production. You are also responsible for ensuring that your use of Next Etch and the websites you build with it comply with applicable laws and third-party terms.

You must not use Next Etch, your account or license system for unlawful purposes, fraud, unauthorized distribution, license sharing or attempts to interfere with or circumvent licensing or security mechanisms.

Suspension and Termination

We may suspend or terminate access to license services, updates or support where there is reasonable evidence of fraud, payment disputes or chargebacks, unauthorized license sharing, abuse of our services, prohibited redistribution or a material breach of these Terms. Where appropriate, we may first provide an opportunity to resolve the issue.

Limitation of Liability

Next Etch is provided on an "as available" basis. While we aim to provide a reliable and well-maintained product, software may contain errors or experience compatibility issues. To the maximum extent permitted by law, we are not responsible for indirect or consequential losses, loss of profits, loss of data, website downtime or damage resulting from the use or inability to use Next Etch.

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited under applicable law.

Governing Law

These Terms are governed by the laws of Spain. For transactions with businesses or professionals, any dispute that cannot be resolved amicably will be submitted to the competent courts of Madrid, Spain, to the extent permitted by law.

If you purchase Next Etch as a consumer, you retain any mandatory protections provided by the laws of your country of residence and any jurisdictional rights that cannot legally be waived.

Changes to These Terms

We may update these Terms when the product, our services or applicable legal requirements change. Updated Terms will be published on nextetch.io. Changes to pricing or future purchase conditions will not retroactively change the price paid for an existing Lifetime Deal or remove mandatory rights attached to an existing purchase.
